Manzoor Khan lawsuits

Six lawyers representing different clients met this morning in Courtroom 8-6 at 330 University Avenue shortly after 10:00 am. They then spent about forty minutes in judge chambers discussing case management.

The lawyers were to meet again at 2:00 pm for the MTCC 943 lawsuit.

I did meet a couple of owners from the 25 Grenville Street condo and we talked about how their corporation got into this mess. I learnt a little more about their condo's history.

I was told that were signs that something was amiss prior to this scandal. The cost of the renovations that were done seemed high and the board resisted having an audit of the invoices.

They elected four new directors at their last AGM, three of them with accounting experience, so they are hopeful that this will not happen again.

The afternoon Case Management Meeting
The Threshold Issue:
Is the loan which is the subject matter of the proceeding enforceable against the condominium corporation?

The condo corporations say that they are not responsible for Khan’s fraudulent loans but the lenders say that they are and the role of others, including the lawyers, are in play.

Justice Brown drew up the following schedule:
15 Sept 12 Affidavits served.
21 Sept 12 Trial Preparation Plan agreement
24 or 25 Sept 12 Case Conference (if required)
January 12 Possible mediation with George Adams
May or June 13 A ten-day hybrid trial consisting of written records, agreed statements of facts and voce (oral) evidence.

The settlement
At their AGM held on Tuesday 11 June 2013, the owners of MTCC # 943 were told that they have come to a settlement and they will not have to pay.

The terms are confidential. However, their lawyer did say that: "other persons are being investigated".
