AGM

To comply with the Condominium Act, the corporation's AGM needed to be held by the end of June 2013 but due to troubles getting the accounts in order and due to missing records covering some of the time when the corporation was managed by Vero Property Management, the AGM was scheduled for
27 July 2013.

The AGM packages were mailed to the owners and the candidates started campaigning by handing out flyers and posting them in the three buildings.

However, there were a couple of incorrect dates in the package materials, including one on the proxy. Then someone complained that there was not 15 clear days between when the packages were mailed and the date of the election.

The board decided to postpone the AGM and the election for two positions on the board until sometime in September.

Election re-scheduled
The AGM was rescheduled for Thursday 26 September 2013 at Don Bosco High School.

There would be an election for two positions on the board. Waqar Khan was not running for re-election so there would be at least one new director.

The campaign
Many condos complain that they have trouble attracting candidates to run for their board of directors. That was not a problem at YCC #42.


The campaigning for proxies by the candidates and their supporters was intense. There were a lot of personal attacks,  accusations of bad conduct and many election posters were torn down.

The incumbent president, Atual Malick took over the management office and used it as his campaign office. He distributed a professionally-printed full colour two-page campaign brochure and, near the end of the campaign, had an assistant call the voters from the management office requesting proxies.

Shah Jahan Khan, who had a court order banning him from YCC #42 lifted, was busy collecting proxies for two candidates, one being Amina Gure. In an e-mail he wrote:
"... cause police trespassed me from 320 and 330 as a result of my 15 days trespass Muhammad Nizamuddin and Malick collected 100 Proxies from my voters."

Later on he says:
"Thanks to GOD late but not too late I started complaining two days ago all of you knew for AMINA GURE occupied resident in Apt. 210/320 since last 23 years running an educated  independent Canadian owned business women from unrepresented Somali community in ycc 42 to positively involve this oppressed community in the RESTORATION OF YCC 42 LIVINGS. ... I am sincerely thankful to 200 unit owners who despite of all hurdles from police, Malick, drug dealers signed their valued proxies for AMINA GURE at least 50 proxies more than any Candidate in race. If any one had doubt I am ready to count."

Sandeep Gosal worked hard collecting proxies, talking to the owners and distributing hundreds of flyers.

Condo fee reduction
In late August, the board announced that they were reducing the common element fees by a further 10%. The opposition candidates figured that this was a cynical move that was made to influence the election and assist Atual Malick's re-election bid.
