Bill 72
“The fact of the matter is that the Condominium Act doesn’t have any consumer protection whatsoever.
—Rosario Marchese

In early May 2012, Rosario Marchese, the New Democrat MPP for Trinity-Spadina, brought forward Bill 72 the Property Owners' Protection Act, a private member’s bill that called for changes to the Condominium Act.

The main points in Bill 72 were:
1.
a Review Board to handle disputes between a condo corporation and an owner instead of using the courts.
2.
improve the Tarion warranty program for new condo buyers.
3.
include condo conversions in the Tarion warranty program.
4.
licensing condo property managers.
5.
improving consumer protection for new condo buyers.

This was the fourth time over the last several years that Marchese tried to get his bill passed.

If this bill passed, purchasers of new condos would be better protected from construction defects and they would be assured that the builder will deliver what he promised.

All condo owners would have benefited from having licensed property managers and an quicker, more inexpensive dispute tribunal to replace the courts.

This would have been a good bill for condominium owners.
