Management and the soliciting of proxies
Starting on 01 February 2018, the Condominium Management Services Act,
prohibits managers, and anyone acting on behalf of management from
soliciting proxies for a meeting where the agenda includes:
(a) any matter directly related to the licensee;
(b) the removal or the election of condo directors; or
(c) any other prescribed matter.
So not only the managers but most likely anyone that the manager
directs such as office clerks, security guards, cleaning staff and
superintendents are affected by this prohibition.
Fixing errors or omissions
A manager cannot
modify or make "corrections" to a proxy.
What can the manager do?
The manager and the staff can:
(a) collect & hold completed proxies.
(b) notify & remind owners to submit their proxies.
(c) give advice on how to submit a proxy.
(d) give owners a proxy form as part of the meeting notice.
(e) give owners a blank proxy form if one is requested.
Collecting proxies solely for quorum purposes
Managers and people acting on their behalf may solicit a
proxy where the proxy is for quorum purposes only. The proxy form
cannot authorize or require the proxy to vote on any matter, including
routine procedures.
Directors soliciting proxies
The manager cannot instruct the directors to solicit proxies.
