Mr. Sardar Saadilla lost this appeal from an order of Justice Michael A. Penny of the Superior Court of Justice, dated 13 January 2017.

Justice Michael A. Penny pointed out that the appellant is a tenant in a condominium unit in YCC # 187, which is a condominium corporation.

The appellant had no standing to sue the Corporation with respect to alleged noncompliance with the Condominium Act, 1998, S.O. 1998, c. 19, or the condominium’s governing by-laws.

He correctly held that the authorizations the tenant’s landlord provided to him do not include suing the condo corporation.

The tenant had to pay YCC #187 a total of $8,500 in costs.
