What’s next?

The judgment was announced and the board was waiting for Justice Penny's ruling on costs.

A united board?
Not likely. On 08 April 2014, Shah Jahan Khan sent the owners of YCC #42 a long e-mail denouncing his political enemies in detail and making claims that the other directors submitted false affidavits and he stated that he was stabbed in the back.

An appeal for an appeal
The heart of the message was:
"APPEAL BEFORE COURT THOUGH YCC#42 Lawyer:

NASRIN, MULAZIM, SHAHID RASOOL and all of you, If you guys want to become alive in YCC#42 community than SAFDER must call a Board meeting ( I and Anver ) will vote to pass a resolution, advising YCC#42 lawyer to file a court review for Proxy instructions, with in limitation time other wise forget future elections, always

Our strength is absentee Pakistani owners.

So Shah Jahan Khan was planning to ask the majority of the board to pass a resolution to have the corporation's lawyer file an appeal of Justice Penny's judgment on the processing of proxies at the next election.

Board meeting
The first board meeting after the trial was held on 15 April 2014.

It was a very productive meeting and the following decisions were made.
1.
Management will prepare a tender that will be published in the Toronto Star to repave the asphalt.
2.
Approved a new reserved fund study.
3.
Chose a qualified engineer to redesign the building entrances for separate entry/exit doors.
4.
Chose an engineer to address the expansion joints for the underground parking garage.

The board is planning to complete the work by November. Some of the major works like the expansion joints and repaving will likely be done in phases depending on the cost and amount of work needed to be done.

The judgment on costs
Justice Penny's award on costs took Anver Karim and Shah Jahan Khan by surprise. These two directors lost the case and were ordered to pay the condo corporation $30,000. They will ask the condo corporation's insurance company to cover their legal costs.

The insurance company would not pay and Anver Karim paid the corporation its costs award.

Budget
The budget for 2014 called for a zero fee increase.

The next AGM
Year end was on 31 December 2013 so the next AGM is due by the end of June 2014.

Two directors are up for re-election; Anver Karim and Safder Sardar. A lot is riding on this election as the balance of power is up for grabs.


AGM, no quorum

The security guards, who are corporation employees, unionized. The manager blamed interference from the board while a couple of guards said that the security manager was playing favourites, gave his daughter a higher rate of pay the the other guards doing the same job and constant threats of discipline and termination.

Summerhill Property Management
In February 2016 Summerhill Property Management was hired by YCC #42. It became its fourth management company in the last four years.

Of the last three management companies that worked at YCC #42 since it came out of court-appointed administration; one was terminated and two resigned.
